Late Availability
Property Booking Conditions

1. Definitions:
‘Member’: Qualifying Property Owner subscribing to the Service for Renting or Swapping purposes.
‘Qualifying Property’, ‘Property’: Any residential property which is not a principal residence and which is used as a holiday home. This specifically excludes timeshare. It must be self contained, with its own kitchen and private bathroom, clean and comfortable, and must be looked after by a local management company.
‘Qualifying Property Owner’: Person or persons owning a Qualifying Property.
‘Our Service’: The offer of a complete holiday rental and exchange service with a worldwide choice of quality holiday homes.
‘JollySwap’: The website www.jollyswap.com owned by Perfect Getaways Ltd.
‘Perfect Getaways listing site’: The website www.perfectgetaways.co.uk and all other Rental Websites owned by Perfect Getaways Ltd.
‘The Website’: Any website owned by Perfect Getaways Ltd.

2.Ownership:
The Website is owned and operated by Perfect Getaways Ltd.

3. Access and use of the sites:
Access and use of The Website are both governed by and conditional upon your acceptance of these terms and conditions. Acceptance will be deemed to be the case by your access and/or usage of the site and further confirmed by the use of a tick box at the appropriate time. Whereas Perfect Getaways Ltd endeavours to make the site available on a continuous basis, it does not warrant the site will be available 24 hours a day, or that it will be free from errors or viruses or other harmful components.

4. Access and use:
The Website restricts access to ‘members only’ areas of the websites via the use of password and user ID. Both of these will be created by you and confirmed by The Website upon confirmation of your membership. By becoming a member you can use all of the websites.

5. Links:
The websites have links to various organisations involved principally in the travel industry, and have been approved by The Website (e.g. flight information, car rental, and insurance websites). Perfect Getaways Ltd takes no responsibility for any information provided by external websites.

6. The Service:
The service offered by The Website is designed exclusively for owners of second properties which are likely to be used by them principally as ‘holiday homes’. All types of timeshare/shared ownership/property bonds are specifically excluded.

7. Jolly Swap:
The system used by JollySwap works on a unique credits system. Credits are earned for all weeks deposited on the following basis:
Studio/1 bed apartment - 1 credit
2/3 bed apartment - 2 credits
3/4 bed villa - 3 credits
5 bed villa or larger - 4 credit
s Credits are earned on this basis for each week deposited. Credits are valid for up to two years. A deposit will have to be re-placed if no member books the deposited week(s) or the member will have their credits deducted. No member is allowed to be in a negative credits situation.
High Season weeks: High season weeks are defined as weeks commencing anytime on or after 17/7 but before 24/8 and on or after 19/12 but before 30/12: Double credits will be earned for any weeks deposited that start on or during these dates.
Out of season weeks: All weeks which do not qualify as high season weeks are classed as out of season weeks. All out of season weeks deposited by Members earn quarter credits per week ie: 4 consecutive weeks will need to be deposited to exchange for one week in high season.

Bookings:
All Bookings are made using the same credits system. EG: A member wanting to book one week in a 5 bed villa in September will need to have deposited sufficient week(s) to qualify for 4 credits.

Fees:
Membership Fee: No membership fees are payable.
Platinum Club membership: Payable at the rate of £20 per annum.
Conversion fee: This is payable once a confirmed booking has been made and is currently £69

Cancellation and Termination:
Cancellation: Members can at any time apply to JollySwap to remove week(s) deposited by them and, so long as the week in question has not been booked and the member hasn’t spent the credits, the week may be exchanged for another week.
Termination: JollySwap reserves the right to suspend and/or terminate your membership at any time if you are in breach of any of your obligations hereunder.

8. Perfect Getaways Listing Site:
Perfect Getaways Listing Site advertises a member’s property in order for the member to rent out their property. Members agree to keep availability up to date at all times so visitors can instantly see if the property is available before making a booking.
Bookings: All bookings are made directly with The Member.

Fees:
Subscription fee: An annual subscription fee is payable which is determined at the time of joining. All subscription fees are guaranteed to not rise within 3 years of joining.
Photographs: Members can show ten photographs free of charge.
Money Back Guarantee: The Member should make contact with Perfect Getaways Ltd between months 12 and 13 of their membership in order to claim back the full advertising subscription fee.
Late Availability/Special Offers: Members can advertise Late Availability and Special Offers for £20 per annum. Once a member has subscribed to this service they can advertise an unlimited number of Special Offers for their property.

11. Contents:
Copyright in The Website, its contents, design and any trademarks are owned by Perfect Getaways Ltd.

12 Limitation of liability:
· Limitations: The innovative services offered via these websites are in essence a holiday swapping and rental opportunity. No contractual relationship will be created between any member and Perfect Getaways Ltd beyond the terms hereby set forth. Accordingly, neither Perfect Getaways Ltd nor its officers, agents nor employees, will be liable for any loss or damage suffered by you (or any third party) arising (directly or indirectly) from your operation or usage of the site, howsoever arising. This limitation also applies to your use of the services of any linked sites.
· Security: We undertake to take all reasonable steps to preserve the security of all information sent to us, but no guarantees or warranties are made, as internet data transmission is not totally secure.
· Indemnity:Perfect Getaways Ltd neither warrants nor guarantees that all the information/details/descriptions contained within the sites is completely accurate or up to date. Usage and reliance on content is at the risk of Members.

13. Privacy policy:
The privacy of all our members is paramount. Accordingly, your personal details will never be passed to any third party, without your specific instructions to do so.

14. Jurisdiction:
These terms and conditions are governed by the Law of England. The parties accordingly submit to the exclusive jurisdiction of the Courts in that Country in the event of any disputes that may arise.

15. General:
These terms and conditions are reviewed periodically and may be revised and updated accordingly at any time.

16. Refer a friend:
The Member should contact Perfect Getaways Ltd with details of the referral. £20.00 will then only be refunded when a full 12 month subscription is taken by the Member’s recommendee. This £20.00 refund applies to the Member only.
We reserve the right to decline a recommendation.
